EXECUTIVE ORDER 9712

AMENDMENT OF EXECUTIVE ORDER NO. 8743 OF APRIL 23, 1941, EXTENDING THE CLASSIFIED CIVIL SERVICE(1)

By virtue of the authority vested in me by section 2 of the Civil Service Act (22 Stat. 403, 404), section 6 of Executive Order No. 8743 of April 23, 1941(2), entitled "Extending the Classified Civil Service," as amended by Executive Order No. 9678 of January 14, 1946(3), is hereby further amended to read as follows:

"SECTION 6 (a). Any person who, in order to perform active service with the military or naval forces of the United States, has left a position (other than a temporary position) which is covered into the classified civil service under section 1 of this order, shall be reinstated in such position or to a position of like seniority, status, and pay in the same department or agency, and may, upon reinstatement, acquire a classified civil-service status: Provided, (1) that he has been honorably discharged from the military or naval service, (2) that he makes application for reinstatement within 90 days after termination of his service with the armed forces or of hospitalization continuing after discharge for a period of not more than one year, and (3) that he qualifies in such suitable noncompetitive examination as the Commission may prescribe.

"(b). Any person who, in order to perform active service with the military or naval forces of the United States, has left a position in any department or agency (other than a temporary position) which is covered into the classified civil service under section 1 of this order, may, upon his application and upon the request of the head of the same or any other department or agency, be reinstated in any position for which the Commission finds he is qualified, and upon reinstatement shall acquire a classified civil-service status: Provided, (1) that he has been honorably discharged from the military or naval service, and (2) that he qualifies in such suitable noncompetitive examination as the Commission may prescribe."
